TRACK & FIELD DREAMS — TERMS OF SERVICE

Welcome to Track & Field Dreams ("TFD," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Track & Field Dreams website, mobile application, and all related services (collectively, the "Platform").

By creating an account or using the Platform, you ("User," "Athlete," "Parent," "Coach," "College Athlete," or "Visitor") agree to these Terms.

If you do not agree, do not use Track & Field Dreams.

1. ELIGIBILITY

1.1 Athletes (High School)

• High school athletes must be 13 years or older to create an account.
• Athletes under 13 must have a parent or legal guardian manage communications on their behalf (per COPPA requirements).

1.2 Parents/Guardians

Parents of minor athletes must:

• Approve the creation of accounts for children under 18
• Monitor communication as permitted by Platform features
• Ensure the accuracy of all provided information

1.3 College Coaches

College Coaches using the Platform must:

• Be an authorized representative of an NCAA, NAIA, NJCAA, or accredited collegiate athletics program
• Agree to abide by all NCAA recruiting rules and bylaws

1.4 College Athletes (NCAA Portal)

College athletes creating "Portal" profiles must:

• Comply with NCAA Transfer Portal regulations
• Only mark themselves "Officially in the Portal" when verified

2. ACCOUNT REGISTRATION

Users must provide accurate and complete information when creating an account.

You agree not to:

• Impersonate any individual or institution
• Provide false or misleading performance marks
• Use another person's account without permission

We reserve the right to suspend or terminate any account with inaccurate, fraudulent, or inappropriate content.

3. SERVICES PROVIDED

Track & Field Dreams provides the following services:

3.1 Athlete Profiles

Athletes may create a profile containing:

• Performance marks (times, distances, heights)
• Academic information
• Contact information
• School and coach details
• Media, images, and videos

Athletes may upload screenshots of official meet results to verify performance.

3.2 Automatic Performance Distribution

When athletes enter new marks:

• Their results may be automatically distributed to college coaches whose performance criteria match the athlete's marks.
• Distribution may include screenshots, event details, and academic information.

3.3 College Coach Tools

Coaches may:

• Create a program profile
• Search and filter athletes
• Receive automatic alerts when athletes meet performance criteria
• Add athletes to their recruiting board
• Communicate with athletes once they have selected them

3.4 NCAA Portal Tools (College Athletes)

College athletes may:

• Create a portal profile
• Upload performance marks
• Notify coaches when they are officially in the NCAA Portal
• Communicate with coaches once activated

4. COMMUNICATION POLICY

4.1 Athlete-Coach Communication

The communication portal only opens when:

• A coach adds an athlete to their Recruiting Board
• The athlete is officially "active" in the NCAA Portal (for college athletes)

4.2 Parent Oversight

Parents of minor athletes will:

• Receive communication alerts
• Have read-only visibility
• Act as the communication proxy for athletes under 13

4.3 Compliance

Coaches and athletes must follow all:

• NCAA rules
• NAIA regulations
• NJCAA guidelines
• State athletic association rules

We are not responsible for violations committed by Users.

5. USER RESPONSIBILITIES

Users agree to:

• Upload only truthful, verifiable performance marks
• Use the Platform respectfully and professionally
• Not harass, threaten, or misuse communication tools
• Not upload inappropriate or copyrighted content

The following are prohibited:

• False marks or fabricated screenshots
• Spam messaging
• Sharing login credentials
• Attempting to extract or scrape data from the Platform
• Posting offensive, sexual, vulgar, or discriminatory content

Violations may result in immediate account removal.

6. PAYMENT & SUBSCRIPTIONS

Some features of Track & Field Dreams require payment, including:

• Athlete memberships
• College coach memberships
• Enhanced visibility tools
• NCAA Portal tools

All payments are:

• Non-refundable
• Non-transferable
• Billed through our authorized payment processor

Track & Field Dreams reserves the right to update pricing at any time, with notice provided to current Users.

7. DATA & PRIVACY

Our Privacy Policy governs how we collect, store, and use your data.

By using the Platform, you agree to the Privacy Policy.

We may share:

• Athlete data with verified college coaches
• College athlete portal data with coaches meeting criteria
• Communication events with parents of minors
• Necessary information to comply with legal requirements

We do not sell personal data to third parties.

8. CONTENT RIGHTS

All content uploaded to your profile (data, images, screenshots, videos, marks, etc.) remains your property.

You grant Track & Field Dreams a limited, nonexclusive license to:

• Display, distribute, and process your information
• Match your profile with college coaches
• Improve Platform functionality

You may delete your content or account at any time, except where archival storage is required by law.

9. PLATFORM ACCESS & AVAILABILITY

We strive for 24/7 availability but do not guarantee:

• No downtime
• No data loss
• No service interruptions

We are not liable for interruptions due to:

• Maintenance
• Hosting provider outages
• Technical issues beyond our control

10. TERMINATION OF SERVICE

We may suspend or terminate accounts that violate these Terms.

Reasons include:

• Fraudulent marks
• Inappropriate communication
• Misrepresentation
• Harassment
• Rule violations related to minors
• Institutional misuse

Users may cancel their account at any time.

Paid fees are non-refundable.

11. LIMITATION OF LIABILITY

Track & Field Dreams is not responsible for:

• NCAA compliance violations
• Scholarship decisions
• Recruiting outcomes
• Misconduct by coaches or athletes
• Incorrect data submitted by Users

Use of the Platform is at your own risk.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Track & Field Dreams, its founders, employees, partners, and agents from any claims arising from:

• Your use of the Platform
• Violations of these Terms
• Your communication with other Users
• Uploaded content or data

13. CHANGES TO TERMS

We may update these Terms periodically.

When changes occur, we will:

• Update the "Last Updated" date
• Notify Users when required by law

Continued use constitutes acceptance of updated Terms.
